Cause of action

This is a class action against the Commonwealth Government (Department of Defence) (DoD) in connection with land contamination arising from the DoD’s use of aqueous film forming foam at the Army Aviation Centre, Oakey (the Contamination).  It will be alleged that DoD allowed the Contamination to escape from the land at the Army Aviation Centre, Oakey causing damage to surrounding property and business owners for which DoD should be liable to pay compensation. 
 
The class action is being run by Shine Lawyers in Queensland. 
 
Shine Lawyers have filed the claim on a 'closed class basis'. This means that the class action is brought only on behalf of eligible property and business owners who entered into a litigation funding agreement with IMF prior to 21 January 2019.
